Routine pruning and trimming of palm trees, yuccas and hedges does not require a permit in any municipality we work in across the Costa del Sol. You can arrange a trim whenever it suits you — no paperwork, no waiting.


Tree pruning: check with your local council first

For trees (as opposed to palms and hedges), pruning rules vary by municipality. Each ayuntamiento sets its own requirements and timelines.

As a general rule, if you want to prune a large tree or a protected species, your local council will tell you what work is permitted and when — and it may not be what you had in mind. Pruning only the side that bothers you, for example, is rarely approved: removing branches asymmetrically can destabilise the tree's structure, and councils are aware of this.

The key point: contact your ayuntamiento before any significant tree pruning work, not after.

 


Tree and palm removal: a permit is required in almost every case

Felling a tree or removing a palm — regardless of species or size — requires prior approval from the Parks and Gardens department (Parques y Jardines) of your local council in virtually all cases across Málaga province.

This is not a formality. The report from Parques y Jardines must justify the removal on legitimate grounds. "I don't like the tree" or "I want to build something there" are not sufficient reasons. The application needs to demonstrate that the tree or palm is causing genuine damage — to structures, to neighbouring properties, or to people.


The one exception: genuine risk of collapse

If a tree or palm is so weakened, diseased or dead that it poses an immediate risk of falling, the permit requirement does not apply in the same way. Safety takes precedence over paperwork.

In practice, this means that if a palm is severely affected by red palm weevil, structurally compromised by disease, or clearly dead and unstable, removal can proceed without waiting for council approval — but the risk must be real and documentable, not a convenient justification.

  1. Confirm with your local ayuntamiento whether a permit is required for your specific situation
  2. If required, prepare a report justifying the removal on grounds of damage or risk
